TERMS AND CONDITIONS – U by Kotex Free Education Sample Packs (2024)

  1. The U by Kotex® Education sample pack offer (Offer) is open to residents of Australia who are Teachers of Years 5, 6, 7 and 8 at schools as listed on the Education Database as used by the Australian Bureau of Statistics. Employees (and their immediate families) of the Promoter and its agencies associated with this sampling offer are ineligible to participate in the Offer.
  2. The Offer is ongoing through 2024 and will continue until the Promoter advises otherwise or until stock of any or all sample(s) is exhausted (Offer Period).
  3. Each individual U by Kotex® pack contains 1 x “All about You” Education Booklet; sample product including 1 x Clutch Bag, 1 x Sports Tampons Regular (8 tampon pouch), 2 x liners, 2 x Petite Pads Regular, 2 x Petite Pads Overnight (Student Pack)
  4. Teachers may claim up to a maximum of six (6) Student Packs (each containing 30 individual sample packs) per school per calendar year
  5. To receive a Student Pack, Teachers must complete and submit an order request form at: www.ubykotex.com.au/teachers  (Promotion Website). A valid email address (being an email address containing a school, government or Department of Health or Education domain) must be provided with the order request form. Upon receipt by the Promoter of a valid and complete order request, Student Packs will be made available online for claimants to download. Verification and acceptance of the order request is at the discretion of the Promoter, whose decision is final.
  6. Student Packs may not be sold and are not transferable or redeemable for cash.
  7. If any product within a Student Pack becomes unavailable, the Promoter may substitute that product with an alternative, comparable product
  8. No responsibility will be taken for late, lost, indecipherable or misdirected claims.
  9. Any cost associated with accessing the Promotion Website is the claimant’s responsibility and is dependent on the internet service provider used. All claims are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the claimant.
  10. Except for any liability that cannot be excluded by law, including liability arising under the Competition and Consumer Act 2010 (Cth) in relation to supply of goods, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Offer, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in a Student Pack to that stated in these Terms and Conditions; or (e) use of the Student Pack.
  11. The Promoter collects Teacher and claimant information in order to conduct the Offer and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, sample pack suppliers and, as required, to Australian regulatory authorities. Claims are conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for research and profiling purposes or to communicate with the claimant about future teaching offers including sending electronic messages or telephoning the claimant. Teachers and claimants should direct any request to access, update or correct information to the Promoter. All claims become the property of the Promoter.
  12. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by visiting www.kca.com.au and https://www.global.kimberly-clark.com/en-au/global-privacy-policy or by contacting the Promoter.
  13. If for any reason the Offer is not capable of running as planned, including but not limited to unavailability of stock, technical difficulties, unauthorised intervention, interference or fraud, the Promoter reserves the right in its discretion, to the fullest extent permitted by law to: (a) modify, suspend, terminate or cancel the Offer or these Terms and Conditions as appropriate; or (b) reject a claim without penalty or obligation to compensate.
